As a mutual company, LMICK is your company. In anticipation of the upcoming Annual Meeting, we wanted to take this opportunity to discuss the state of the company and reflect a bit on 2019.

KENTUCKY LAWYERS DESERVE STEADFAST SUPPORT

Importantly, 2019 marked the Company’s 13th consecutive profitable year. This accomplishment was made possible, in large measure, by your continued support. LMICK exceeded industry averages and renewed 96% of our insured attorneys. We also welcomed 89 new attorneys as LMICK insureds. Peer-to-peer recommendations are the lifeblood of the Company’s success. Thank you to all who’ve recommended us to a colleague.

Over the past 18 months, we’ve invested in updating our core values, refreshing our corporate brand and expanding the Company’s digital footprint. These core values are mirrored in our Brand and all marketing platforms, including www.lmick.com, LinkedInFacebookInstagram, and Twitter.

Perhaps the most significant development in 2019 was the rate reduction provided to LMICK’s mutual members for renewals from July 1, 2019 through June 30, 2020. The net effect the rate reduction had on your particular renewal premium depended upon whether your firm’s makeup and practice changed from the previous policy year. Changes in membership, type and percentage of practice, CLE credits and other factors alter the bottom line, but comparing apples to apples, many of your premiums were lower.

YOU’VE GOT THEIR BACKS, WE’VE GOT YOURS

Your claims team consists of Jane Long, Pete Gullett and me. Notwithstanding the pandemic and remote working arrangements, we’ve remained committed to helping you avoid claims, assisting with claims repair and protecting you against financial loss when claims arise that cannot be repaired. You, our insureds, understand the importance of having professional liability insurance coverage. If you are aware of an attorney without coverage, please remind him or her that Kentucky lawyers will face an average of 2.3 legal malpractice claims/lawsuits over the course of his or her career.

LMICK’s data from 2019 showed a spike in claims to 4.71 per 100 lawyers insured. Plaintiff’s personal injury law and real estate work continue to be the practice areas with the most claims. We experienced an uptick in the number of collection/bankruptcy claims during 2019 and anticipate more of those claims as a result of the financial difficulties associated with the pandemic. Due to the increase in claims generated by collection and bankruptcy cases, we developed a presentation specific to Fair Debt Collection Practices Act (“FDCPA”) cases and presented it at each KLU in the fall of 2019. We suspect this presentation will continue to be timely and relevant.

SERVING YOUR PRACTICE AS OUR OWN

In addition to the aforementioned FDCPA presentation, we added 5 new programs to the LMICK CLE/presentations library in 2019. We’ve developed 2 additional programs thus far in 2020 as well. If you would like to schedule a LMICK presentation for your group event, please contact us. On average, we attend 60 meetings and events and present 30 hours of CLE each year. It is unlikely that we will hit those marks in 2020 in light of the pandemic. Nonetheless, we are attending meetings remotely and presenting virtually. We are committed to being as present and available as always. Some of you may have seen two honorary LMICK staffers, Nancy Meyers’ children, at a KJA meeting or two. These are interesting and challenging times to be sure, but we are resolute in our dedication to supporting your practice.

In 2019, LMICK added a number of terrific lawyers to its Board. We welcomed Thomas N. Kerrick of Kerrick Bachert, PSC; Jennifer L. Lawrence of The Lawrence Firm, PSC and Sarah M. McKenna of Dinsmore & Shohl, LLP. Further, Dulaney L. O’Roark was elevated to Director Emeritus.
