Extension of Filing Deadlines for Supreme Court of Kentucky and Kentucky Court of Appeals

On March 6, 2020, Governor Beshear entered Executive Order 2020-215 and declared a State of Emergency in response to the novel coronavirus (COVID-19) emergency in the Commonwealth. In light of this measure and to protect the health and safety of court employees, elected officials, and the general public, this Court entered 2020-11 and 2020-17 extending appellate deadlines falling between March 16, 2020 and May 1, 2020 by a total of 30 days. In furtherance of these previous Orders, the Court hereby ORDERS as follows:

  1. Notwithstanding CR 6.01, CR 6.02, and RCr 1.10(a),(b), and (e), the time to perform the filing of notices and motions pursuant to CR 73.02, CR 76.20, CR 76.36, and the filing of briefs pursuant to CR 76.12 in the Supreme Court of Kentucky and the Kentucky Court of Appeals between May 1, 2020 and May 31, 2020, is hereby extended by thirty (30) days.
  2. All other pleadings, including motions for reconsideration, petitions for rehearing, or responses to disclosures made pursuant to SCR 4.300 (Rule 2.11(C) of the Kentucky Code of Judicial Conduct) shall be filed within usual timeframes unless a timely motion for extension is granted.
  3. Any deadline previously extended pursuant to 2020-11 or 2020-17 is not extended further by operation of this Order. Any additional extension of time shall be upon motion only.
  4. The Office of the Clerk of the Kentucky Court of Appeals and the Office of the Clerk of the Supreme Court of Kentucky shall continue to receive filings by mail while operating with reduced staffing.
  5. The Clerk of the Kentucky Court of Appeals and the Clerk of the Supreme Court of Kentucky may, in their discretion, make arrangements with counsel to receive filings electronically and to distribute service in accordance with CR 5.02 as appropriate.
